Terms & Conditions & Delivery Conditions

These General Terms and Conditions apply to all orders placed through the meinspielzeug.ch online shop operated by meinspielzeug AG. Where the masculine form “customer” is used below, it naturally also refers to female customers.

Offer and Conclusion of Contract

Products may differ in design, shape and colour from the images shown online. We reserve the right to make technical changes, correct errors and make interim sales. The availability of individual items depends heavily on current demand. Stock levels in the online shop are updated several times a day. If a product ordered cannot be supplied in the quantity requested, you will be informed by email.
 
By clicking the “Buy Now” button, you place a binding order for the products listed on the order page. Receipt of the order is communicated by means of an automatically generated order confirmation sent to the email address provided by you. The purchase contract is only concluded when meinspielzeug AG confirms shipment of the goods by email or, at the latest, upon delivery of the goods.

Delivery

Deliveries are possible within Switzerland and Liechtenstein. Standard delivery takes place from Monday to Friday via Planzer, Swiss Post or DPD. Orders placed by 3:30 p.m. are processed on the same day (Monday to Friday). meinspielzeug AG is not liable for delivery delays attributable to the manufacturer, suppliers or the appointed transport company. For parcels with the status “delivered/deposited”, meinspielzeug AG assumes no liability in the event of theft. Shipments are insured during transport. If the parcel shows obvious signs of damage, please refuse acceptance. If the goods were damaged during shipping, please inform us within 3 days of receiving the parcel.

Depositing parcels at the front door
In the event of your absence, the delivery service may deposit the parcel at your front door. If you do not wish for a parcel to be deposited, you can contact the Swiss Post customer service (tel. 0848 888 888, email kundendienst@post.ch) or the Planzer customer service (tel. 0848 00 19 36) in advance by telephone or email. The relevant changes will then be recorded in the delivery service provider's system. With Planzer, you can also disable parcel deposits via shipment management, and with Swiss Post via “My consignments”.

Prices

All prices are stated in CHF (Swiss francs) and include statutory value added tax. We reserve the right to change prices. In the event of obvious typing or calculation errors, we are entitled to withdraw from the contract.

Payment

Payment can be made by credit card, Twint or invoice. Payment by invoice (up to a maximum of CHF 450) is not available for all offers and requires a successful address and credit check. In individual cases, we reserve the right to require payment in advance after receipt of the order. The payment period for purchases made by invoice is 30 days.

If the customer fails to meet their payment obligation, they will be in default upon expiry of the specified payment period without any further reminder being required.

The outstanding invoice amount, including default interest and reminder fees (claim amount), may be assigned to Intrum AG for debt collection purposes. In addition to paying the invoice amount, the customer is also obliged to reimburse all costs incurred as a result of the payment default. For processing fees in the event of payment default, please see www.fairpay.ch.

Right of Withdrawal

The customer may withdraw from their order within 30 days of receiving the goods without giving any reason, either in writing (by letter or email) or simply by returning the goods to meinspielzeug AG - Riedäckerstrasse 9 - 8422 Pfungen. Returns must be made in unused and undamaged condition and in the original packaging. Returns are made at the customer's expense and risk. Sealed or plastic-wrapped products may only be returned if unopened. Items specially procured for the customer are excluded from the right of withdrawal. Any damage caused by careless handling or inadequate packaging when returning the goods shall be borne by the customer. Upon receipt of the goods, any purchase price already paid will be refunded to the customer. The small-quantity surcharge and any postage or other shipping costs will not be refunded when returning a product or the entire order and will be charged accordingly.

Warranty

A statutory warranty period of 2 years applies. Under the law, the warranty covers defects that make the use of an item impossible or significantly impair its use. The warranty does not cover damage caused by force majeure or damage for which the customer is responsible due to careless handling or normal wear and tear. Liability for consumables, batteries and rechargeable batteries is excluded. In the event of justified claims, meinspielzeug AG decides whether the item will be repaired, replaced or the purchase price refunded. The compensation can in no case exceed the purchase price. Defective items can only be exchanged in their entirety. Please do not send individual parts without first consulting meinspielzeug AG. The customer must send the defective item to the service centre designated by meinspielzeug AG at their own expense and risk. In the case of justified claims, meinspielzeug AG will cover the cost of returning the item to the customer. Please contact us before sending an item under warranty – in many cases, a photo is sufficient for a free warranty replacement.

Liability

The customer is responsible for the use of the products. Claims for damages are excluded. Under no circumstances shall meinspielzeug AG be liable for consequential or indirect damages. 

Data Protection

meinspielzeug AG undertakes to comply with applicable data protection requirements when processing customer data. The data required to process transactions is stored and may, where necessary, be disclosed to affiliated companies as part of order processing. When purchasing on invoice, an address and credit check is carried out in cooperation with Intrum AG . All personal data is transmitted in encrypted form, treated confidentially and is not disclosed to third parties for advertising purposes. Retention of Title

The delivered items remain the property of meinspielzeug AG until full payment has been made. The corresponding security rights may be transferred to third parties.

Final Provisions

Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by the applicable statutory provisions.

The place of jurisdiction is 8400 Winterthur. Swiss law shall apply.
